General Terms and Conditions of MIRA SOUTH SEA PEARLS

1 .Scope of application
The following terms and conditions apply to all orders placed via our online shop by consumers and entrepreneurs.

A consumer is any natural person who concludes a legal transaction for purposes that can predominantly be attributed neither to their commercial nor their independent professional activity. An entrepreneur is a natural or legal person or a partnership with legal capacity who or which, when entering into a legal transaction, acts in exercise of his or its trade, business or profession.

The following applies to entrepreneurs: If the entrepreneur uses conflicting or supplementary general terms and conditions, their validity is hereby rejected; they shall only become part of the contract if we have expressly agreed to them.


2. Contractual partner, conclusion of contract
The purchase contract is concluded with Mira South Sea Pearls KLG.

By placing the products in the online shop, we make a binding offer to conclude a contract for these items. You can initially place our products in the shopping basket without obligation and correct your entries at any time before sending your binding order by using the correction aids provided and explained for this purpose in the order process. The contract is concluded when you accept the offer for the goods contained in the shopping basket by clicking on the order button. Immediately after sending the order, you will receive another confirmation by e-mail.


3. Contract language, contract text storage
The language available for the conclusion of the contract is German.

We save the text of the contract and send you the order data and our General Terms and Conditions in text form. You can view your order in our customer login.


4. Delivery and sales conditions
After confirming your order, we will send the items you have ordered to the delivery address you have specified in the form of a beautiful parcel. The usual delivery time is 2-3 working days.

Should the delivery of the goods fail despite repeated delivery attempts, MIRA South Sea Pearls may withdraw from the contract


5. offer
Our online offer is subject to change and non-binding. As a rule, the items offered in the online shop are available. Should it not be possible to deliver one or more items due to a stock discrepancy, Stadtlandkind will inform you of this as soon as possible and offer you equivalent items. If none of these items are suitable for you, the amount will be refunded.


6. prices
Our sales prices are ex warehouse and are quoted in Swiss francs excluding shipping costs. 


7.1 Area of validity
We deliver throughout Switzerland and the Principality of Liechtenstein.


7.2 Shipping costs
For our delivery within Switzerland and the Principality of Liechtenstein you pay a delivery charge of CHF 6.90 up to CHF 100. Orders over CHF 100 are free of charge.

You can also pay for your order by TWINT, PayPal or by credit card (VISA, Mastercard) via the secure payment system "Shopify Payments". The fees of the card institutions are borne by "Mira South Sea Pearls".



9. transport damage
The following applies to consumers: If goods are delivered with obvious transport damage, please complain about such defects to the deliverer as soon as possible and contact us immediately. Failure to make a complaint or contact us has no consequences for your legal claims and their enforcement, in particular your warranty rights. However, you will help us to assert our own claims against the carrier or the transport insurance company.


10 Warranty and guarantees
Unless expressly agreed otherwise below, the statutory liability for defects applies. Mira South Sea Pearls KLG expressly reserves the right to provide the buyer with a defect-free replacement in the event of asserted and established defects in the purchased item.

The above restrictions and shortened deadlines do not apply to claims based on damages caused by us, our legal representatives or vicarious agents
- in the event of injury to life, limb or health
- in the event of wilful or grossly negligent breach of duty and fraudulent intent
- in the event of a breach of essential contractual obligations, the fulfilment of which is essential for the proper execution of the contract and on the observance of which the contractual partner may regularly rely (cardinal obligations)
- within the scope of a guarantee promise, if agreed
- insofar as the scope of application of the Product Liability Act


11. gift voucher
Gift vouchers are vouchers that you can purchase. You can pay for your order with a voucher from Mira South Sea Pearls. To do this, enter the code on the voucher in the appropriate field of the order. A gift voucher can only be redeemed before completing the order process and for the full amount.

The amount of the gift voucher is fixed. Gift vouchers are only issued in CHF and are freely transferable.

Cash payment is excluded.


12. promotional vouchers
Promotional vouchers are vouchers that cannot be purchased, but which we issue as part of advertising campaigns. Promotional vouchers can only be redeemed under the conditions stated therein, by the respective recipient, during the specified period and only once per person. Individual products may be excluded from voucher campaigns.

Promotional vouchers can be redeemed from a minimum order value of CHF 20; the value of the goods must in any case be at least equal to the amount of the promotional voucher. Any difference to a higher value of goods must be settled using the payment options offered. Promotional vouchers are neither paid out in cash nor do they bear interest.

A refund or re-delivery of promotional vouchers in the event of partial or complete return of the ordered products is excluded. Promotional vouchers can only be redeemed before completion of the order process. Subsequent crediting is not possible. The promotional voucher is non-transferable and may not be combined with other promotional vouchers. If you have used a promotional voucher for your purchase, we reserve the right to charge you the original price of the goods you are keeping if - due to your cancellation - the total value of the order falls below the value of the promotional voucher.


13 Retention of title
The goods remain our property or the property of the supplier until full payment has been made.

17. right of return
You may cancel the contract within 14 days of receipt of the goods by returning the goods with a description of the reason for the return. The return of the goods is at your own risk and expense.

Only items that are absolutely undamaged and in perfect, unworn condition will be accepted for return. The items must be returned in their original, unadhesive and undamaged packaging. In particular, worn, soiled, damaged or badly smelling products cannot be returned. If this is not the case, we reserve the right to assert claims for compensation.

20. final provisions
Should any provision of these General Terms and Conditions be invalid, the remainder of the contract shall remain valid. In place of the invalid provision, the relevant statutory provisions shall apply.
